Frequently Asked Questions by NRI Investors
Essential legal and financial principles governing real estate transactions for Non-Resident Indians (NRIs) and Overseas Citizens of India (OCIs).
Can a Non-Resident Indian (NRI) or OCI purchase residential property in India?
Yes. Under the general permission granted by the Reserve Bank of India (RBI) under the Foreign Exchange Management Act (FEMA), NRIs and OCIs can freely acquire residential and commercial properties in India without requiring any special approval from the RBI. (Agricultural land, plantation property, and farm houses are excluded from this general permission).
What are the approved modes of payment for property purchases by an NRI?
Payment for property must be made in Indian Rupees (INR) through normal banking channels by way of inward remittance from abroad, or through funds held in Non-Resident External (NRE), Foreign Currency Non-Resident (FCNR), or Non-Resident Ordinary (NRO) bank accounts in India. Payments cannot be made by traveller's cheque or foreign currency notes.
Do I need to be physically present in India to register the property?
No, your physical presence is not mandatory. You can execute a specific Power of Attorney (POA) in favour of a trusted representative, family member, or legal counsel in India. The POA must be signed by you, attested at the Indian Embassy or Consulate in your country of residence, and subsequently adjudicated/registered in India.
Are home loans available in India for NRI buyers?
Yes. Leading Indian banks and housing finance corporations (including HDFC Bank, State Bank of India, and ICICI Bank) offer customized home loans to NRIs for acquiring residential property in India, financing up to 75% to 80% of the agreement value, with repayment through NRE or NRO banking channels.
Can rental income and capital gains from the sale of property be repatriated abroad?
Yes. Net rental income (after payment of applicable Indian income taxes) is fully repatriable under the current account facility. Furthermore, sale proceeds of residential properties purchased out of foreign exchange can be remitted up to the original foreign currency investment, and up to USD 1 Million per financial year under the general RBI remittance scheme upon payment of applicable capital gains taxes and Form 15CA/CB certification.
